The Houston Social Security Disability Benefits office evaluates your application and appeal based on documentation you and your Houston Social Security Disability Attorney present. In order to win your case your attorney must obtain the proper evidence. Each type of disability has different types of documentation that you must present to the Social Security Disability office. Here we will review the documentation required as part of a claim for disability based on Mental Disorder.

The documented evidence you present to the Houston Social Security Disability office must be sufficient to (1) establish the presence of a medically determinable mental impairment(s), (2) assess the degree of functional limitation the impairment(s) imposes, and (3) project the probable duration of the impairment(s). Medical evidence must be sufficiently complete and detailed as to symptoms, signs, and laboratory findings to permit an independent determination. In addition, the Houston Social Security Disability office will consider information from other sources when they determine how the established impairment(s) affects your ability to function. They will consider all relevant evidence in your case record.

Your claim will likely be denied if you do not present the required documentation to the Houston Social Security Disability office, even if you are disabled. Speak with a Houston Social Security Disability Lawyer today if your application has been denied in the last 60 days and increase your odds of winning the benefits you need. You have already been denied benefits, do not make the same mistake twice! Remember, there is no fee unless you win.

Schizophrenia, paranoia, and psychotic disorders are common claims for Houston Social Security Disability benefits. In order to be successful with your claim for benefits if you suffer from these conditions your Houston Social Security Disability Lawyer must prove certain facts.

In the context of Texas Social Security Disability benefits, schizophrenia, paranoia, and other psychotic disorders are characterized by the onset of psychotic features with deterioration from a previous level of functioning.

In order to win your claim for Houston Social Security Disability Benefits due to schizophrenia, paranoia, or other psychotic disorder your Houston Social Security Attorney must prove the following conditions if you are unable to win your case on the factors we discussed in Part 1 and Part 2 of this series.

The required level of severity exists when your attorney can prove you have medically documented history of a chronic schizophrenic, paranoid, or other psychotic disorder of at least 2 years’ duration that has caused more than a minimal limitation of ability to do basic work activities, with symptoms or signs currently attenuated by medication or psychosocial support, and one of the following:

1. Repeated episodes of decompensation, each of extended duration; or

2. A residual disease process that has resulted in such marginal adjustment that even a minimal increase in mental demands or change in the environment would be predicted to cause the individual to decompensate; or

3. Current history of 1 or more years’ inability to function outside a highly supportive living arrangement, with an indication of continued need for such an arrangement.

If you suffer from schizophrenia, paranoia, or other psychotic disorder you may be eligible for Social Security Disability benefits. Speak with a Houston Social Security Disability Lawyer today if your application has been denied in the last 60 days and increase your odds of winning the benefits you need.

Depression, Manic Depression, and Bipolar syndrome are common claims for Houston Social Security Disability benefits. In order to be successful with your claim for benefits if you suffer from these conditions your Houston Social Security Disability Lawyer must prove certain facts.

Texas Social Security Disability categorizes these conditions as Affective Disorders. These disorders are characterized by a disturbance of mood, accompanied by a full or partial manic or depressive syndrome. Mood refers to a prolonged emotion that colors the whole psychic life; it generally involves either depression or elation.

The first step in winning your Texas Social Security Disability benefits for depression or other mental disorder is to provide medically documented evidence of the persistence, either continuous or intermittent, of one of the following:

Depression characterized by at least four of the following:

a. Anhedonia or pervasive loss of interest in almost all activities; or

b. Appetite disturbance with change in weight; or

c. Sleep disturbance; or

d. Psychomotor agitation or retardation; or

e. Decreased energy; or

f. Feelings of guilt or worthlessness; or

g. Difficulty concentrating or thinking; or

h. Thoughts of suicide; or

i. Hallucinations, delusions, or paranoid thinking; or

Manic syndrome characterized by at least three of the following:

a. Hyperactivity; or

b. Pressure of speech; or

c. Flight of ideas; or

d. Inflated self-esteem; or

e. Decreased need for sleep; or

f. Easy distractibility; or

g. Involvement in activities that have a high probability of painful consequences which are not recognized; or

h. Hallucinations, delusions or paranoid thinking; or

Bipolar syndrome with a history of episodic periods manifested by the full symptomatic picture of both manic and depressive syndromes (and currently characterized by either or both syndromes).

If you meet the criteria described above you may be able to win your claim for Houston Social Security Disability Benefits. We will discuss the second step to proving your claim in the next post. If your claim for Social Security Disability benefits has been denied within the last 60 days speak with a Houston Social Security Disability Lawyer today to improve your chance of winning on appeal.
