We previously discussed two criteria for winning your Houston Texas Social Security Disability benefits if you suffer from depression, manic syndrome, or bipolar syndrome. If you do not meet the criteria described in those posts, there is a third strategy for winning your appeal.

If you do not meet the previous criteria, then in order to win Houston Social Security Disability benefits your Houston Social Security Disability Lawyer must be able to demonstrate to the hearing officer that you have a medically documented history of a chronic affective disorder of at least 2 years’ duration that has caused more than a minimal limitation of ability to do basic work activities, with symptoms or signs currently attenuated by medication or psychosocial support, and one of the following:

1. Repeated episodes of decompensation, each of extended duration; or

2. A residual disease process that has resulted in such marginal adjustment that even a minimal increase in mental demands or change in the environment would be predicted to cause the individual to decompensate; or

3. Current history of 1 or more years’ inability to function outside a highly supportive living arrangement, with an indication of continued need for such an arrangement.

If you have been denied Houston Social Security Disability Benefits in the last 60 days, then speak with a Houston Social Security Disability Attorney today to see if you can win your case on appeal. And remember, there is no legal fee unless you win.

If you suffer from any of the conditions associated with Depression, Manic Depression or Bipolar syndrome that we previously discussed there is a second part to the legal test that you must prove in order to win your claim for Houston Social Security Disability Benefits. If you do not meet the criteria we previously covered, then suffering from any of these conditions is legally irrelevant.

In order to pass the second step of the test for Houston Social Security Disability, your depress, manic depression, or bipolar syndrome must result in at least two of the following:

Marked restriction of activities of daily living; or

Marked difficulties in maintaining social functioning; or

Marked difficulties in maintaining concentration, persistence, or pace; or

Repeated episodes of decompensation, each of extended duration.

If you do not meet any of these criteria, there is still a third strategy for qualifying for Texas Social Security Disability Benefits. We will cover this final strategy next time.

If your application for Houston Social Security Disability benefits has been denied in the last 60 days speak with a Houston Social Security Disability Lawyer today to see if you can win your case on appeal.

Depression, Manic Depression, and Bipolar syndrome are common claims for Houston Social Security Disability benefits. In order to be successful with your claim for benefits if you suffer from these conditions your Houston Social Security Disability Lawyer must prove certain facts.

Texas Social Security Disability categorizes these conditions as Affective Disorders. These disorders are characterized by a disturbance of mood, accompanied by a full or partial manic or depressive syndrome. Mood refers to a prolonged emotion that colors the whole psychic life; it generally involves either depression or elation.

The first step in winning your Texas Social Security Disability benefits for depression or other mental disorder is to provide medically documented evidence of the persistence, either continuous or intermittent, of one of the following:

Depression characterized by at least four of the following:

a. Anhedonia or pervasive loss of interest in almost all activities; or

b. Appetite disturbance with change in weight; or

c. Sleep disturbance; or

d. Psychomotor agitation or retardation; or

e. Decreased energy; or

f. Feelings of guilt or worthlessness; or

g. Difficulty concentrating or thinking; or

h. Thoughts of suicide; or

i. Hallucinations, delusions, or paranoid thinking; or

Manic syndrome characterized by at least three of the following:

a. Hyperactivity; or

b. Pressure of speech; or

c. Flight of ideas; or

d. Inflated self-esteem; or

e. Decreased need for sleep; or

f. Easy distractibility; or

g. Involvement in activities that have a high probability of painful consequences which are not recognized; or

h. Hallucinations, delusions or paranoid thinking; or

Bipolar syndrome with a history of episodic periods manifested by the full symptomatic picture of both manic and depressive syndromes (and currently characterized by either or both syndromes).

If you meet the criteria described above you may be able to win your claim for Houston Social Security Disability Benefits. We will discuss the second step to proving your claim in the next post. If your claim for Social Security Disability benefits has been denied within the last 60 days speak with a Houston Social Security Disability Lawyer today to improve your chance of winning on appeal.
